mahtso - I understand your comment is a long time ago, but I just read it now.

It is not always, and I'd say not a majority of the time, that someone held in contempt gets to avoid the punishment by some action. Yes, frequently, but ai wouldn't say a majority of the time. You can see many videos on YouTube of judges imposing contempt charges/punishments for people with no mention of a way to avoid the punishment.

That the judge gave the officer a way out is just a gift/bonus for the officer.

As far as "attorney Joanne Cuccia", there is no indication that she will unreasonably withhold acceptance of his apology if it is sincere, and that's irrelevant until after he gives the apology. If his apology is sincere, and she doesn't accept it, he can make the case then that she is acting unfairly or unreasonably. This is only to prevent him from making an insincere apology like: "OK, I'm sorry I got caught taking your papers".

bigsurkate - I understand it's been a few years since your comment, and the article was published almost 9 years ago, but I feel this sort of behavior from officers is timeless. I have seen the video, and other articles before, but this is the first I've seen that talks about anything beyond the paper-taking incident itself.

I agree with you 100%. Also, you didn't mention it, but I think that it's very telling that the officer was initially standing at least 20 feet away from the file/folder. At that point he could not have possibly had any cause to do inspect the folder. He couldn't have known what he might find and just decided to "go fishing". He walked over to the file and began reading and rummaging through it, and well, you know the rest.

This guy is a freaking moron! Taking papers from a defense attorney claiming he saw words "going to", "steal" and "money", as if he really suspected a crime to take place, when she's a defense attorney, committed to representing objective statements.

Get real, man! Get the f, real! He deserved to lose his job!

There seems to be this ongoing lack of accountability with anyone associated with court staff. A motherload of hypocrisy in their duties to uphold the law; judiciary corruption.

So that 1 deputy had his car stolen by a naked woman, earlier this year. Deputy Francisco Campillo has been a Maricopa County Sheriff’s Deputy since 2005 and is currently assigned to the District 2 Substation. Deputy’s actions in handling this incident are under review by Maricopa County Sheriff’s Office Professional Standards Bureau.

since we don't know what was on the paper, let's assume (i know i know) that what he saw in plain sight alrmed him to collect it as evidence in some other matter not pertaining to the current case. I.e. you stop a driver for speeding and notice a large bag of weed on the seat which justifies a search of the car. That being said, He should have stated such at the time, which would have given the judge the opportunity to examine thepaper andagree or correct him and restore everything (including the copies presumedly made).

Personal lay oppinion, the judge should have taken control of her court room and dealt with it right there instead of waisting all that time worrying about her schedule, trying reschedule with the attorneys.

A word to the wise to the attorney, if you dont want people seering it, dont leave it out in plain sight.

For those of you who don't know Sheriff Arpaio retaliated against Judge Donahue by charging him with 3 felonies including bribery. This type of intimidation and retaliation appears to be a normal course of business for Sheriff Arpaio as he is well known for using his office to intimidate and harass anyone who disagrees with him or anyone he sees as a political adversary. This also explains why the first judge was so apprehensive of confronting the deputy.

In the end Donahue as well as 2 other judges who were illegally and unethically targeted by Sheriff Arpaio won their lawsuits against him and were awarded over 8.5 million dollars in punitive and treble damages.

Sheriff Arpaio has cost the taxpayers of Maricopa county a staggering amount of money in legal fees and damages. I don't know how Maricopa country can afford it.

At this point I've lost track of how much taxpayer money has been paid out in legal damages resulting from unethical, retaliatory, abuse of power or civil rights law suits against Sheriff Arpaio. In fact there was just another case settled for 25 million dollars. So It's got to be getting close to 100 million dollars thus far.

I don't understand why he was not charged with theft?
If a citizen did this they would be in a lot more trouble than simply apologizing. The sheriffs decision not to apologize is beyond stupid. Stoddard should be arrested and then fired. Why does the public allow this type of two justice systems one for the police and one for us. I think an apology is insufficient and undermines law and order.
There is no law and order if there is two justice systems.
This really shows the entire justice system is broken and the lack of law.I would know that taking the file was illegal and wrong and protected. Stoddard works there every day and so he definitely knew his actions were illegal except the system is so corrupt that this moron thought he could do as he pleased even in a court of law. He does not respect the judge or the court or the law. It does not matter what reason he had for stealing or that he returned it.
The guy being tried should get a pass or the case dismissed.
